Terms of Service

This Hire Agreement ("Agreement") is entered into between Gulp Bins Ltd (NZ) ("Company") and the hirer ("Hirer"), collectively referred to as the "Parties," for the hire of waste bins and related equipment provided by Gulp Bins Ltd (NZ). This Agreement sets forth the terms and conditions that govern the hire arrangement.

Equipment Hire
a. The Company agrees to provide the Hirer with waste bins and related equipment as specified in the hire order.
b. The Hirer acknowledges that the equipment remains the property of the Company at all times.

Hire Period
a. The hire period shall commence on the agreed start date and continue for the duration specified in the hire order.
b. The Hirer may request an extension of the hire period by providing written notice to the Company at least 24 hours prior to the end of the original hire period. The Company reserves the right to accept or decline such extension requests.

Hirer's Responsibilities
a. The Hirer agrees to use the equipment solely for its intended purpose and in accordance with any applicable laws or regulations.
b. The Hirer shall take all necessary precautions to prevent damage to the equipment during the hire period.
c. The Hirer is responsible for the safekeeping and security of the equipment during the hire period.
d. The Hirer shall not make any alterations or modifications to the equipment without the prior written consent of the Company.

Payment Terms
a. The Hirer agrees to pay the hire charges as specified in the hire order. Payment shall be made in full prior to or upon delivery of the equipment.
b. The Hirer shall be responsible for any additional charges incurred due to loss, damage, or late return of the equipment.
c. In the event of late payment, the Company reserves the right to charge interest at a rate of [insert applicable rate] per month on the outstanding amount.

Loss or Damage
a. The Hirer shall be liable for any loss or damage to the equipment during the hire period, excluding fair wear and tear.
b. The Hirer shall promptly notify the Company in writing of any loss, damage, or malfunction of the equipment.

Termination
a. Either Party may terminate this Agreement by providing written notice to the other Party in the event of a material breach of any provision of this Agreement.
b. Upon termination, the Hirer shall promptly return the equipment to the Company in good working condition, subject to any applicable charges for loss or damage.

Limitation of Liability
a. The Company shall not be liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use the equipment.
b. The Hirer agrees to indemnify and hold the Company harmless against any claims, damages, losses, or expenses arising out of the Hirer's use of the equipment.

Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of New Zealand.

Entire Agreement
This Agreement constitutes the entire understanding between the Parties with respect to the subject matter hereof and supersedes all prior agreements, whether oral or written.
